Legal Status of Croatian Casinos

Casino gambling is perfectly legal in Croatia! Following the 2014 gambling law, 'Zakon o grama na sreću' is just one form of gambling that is legal in Croatia, which is broken down into four categories of lottery games, games of chance with an instant win (e.g., scratch cards), sports betting, and slot machines (including video poker).

Casinos wishing to offer these services must hold a valid license from the Ministry of Finance in the country.

However, that's just the situation for land-based operations. Online casino gaming has been legal in Croatia since 2010 but was a little unclear. The 2014 legislation clarified the position and introduced some not-too-popular regulations amongst operators.

Following similar rules in certain US states, the first condition of being licensed to operate an online casino in Croatia is the operator must also have a land-based operation in the country, which was seen as somewhat prejudiced against offshore online casinos. However, this does not mean there aren't offshore online casinos that don't accept players from Croatia!

Operators must also have an online gambling license issued by the Ministry of Finance, which comes with the unusually steep fee of 3,000,000 HRK per year and the requirement that at least 3,000,000 HRK must be kept in reserve at all times to cover players' winnings.

There are also taxes that operators must pay, with those on slots some of the highest in the industry at 25%. Players are also responsible for paying tax on their winnings, ranging from 10% to 30% based on how much was won.

Minimum Age to Gamble

All forms of gambling in Croatia are permitted by people aged 18 and over. This covers everything from playing the national lottery to betting on sports, playing in land-based casinos, to getting your casino gaming online.

Gambling authority license holders are required by law to ensure that they advertise the legal age limits on their site, but their responsibilities also extend beyond that. KYC, or Know Your Customer checks, are also required by law to ensure that players are who they say they are.

This means you'll be asked to provide documentary evidence, such as a passport or ID card, to prove your age, amongst other things.

Online casinos also implement other methods of ensuring that underage gamblers do not have access to their site, such as requiring a date of birth on sign-up, offering secure login, and encouraging members to protect their children and prevent them from seeing their online gaming activities and accessing their account.

Legal Situation of Gambling at Croatian Online Casinos

As in many parts of the world, online gambling has become rather popular in Croatia, which probably helped when Croatia became a member of the EU, which resulted in more interest in the region from online gambling operators.

Even though Croatia currently only issues online gambling licenses to land-based casino operators in the region, many online worldwide casinos accept players from Croatia.

Due to the legal situation, this is what's known as a grey area in which licensed online casinos operating outside of Croatia can still legally accept players from the country due to their regulatory base being within the EU, of which Croatia is a member country.

History of Gambling in Croatia

Croatia was one of the first countries in the region to legally allow and regulate gambling, which happened back in the 1960s. When Croatia became independent, the gambling industry in the newly emerged country took off, especially after the law of 2010 made it legal, with resort-style casinos attracting a lot of tourism.

However, sports betting was the first form of gambling to get the green light in the country. Private operators Sport Tip and Prva Sportska Kladionica were the first to set up shop and are now the leading bookmakers in Croatia.

Online casino gambling in Croatia came relatively recently in the lottery, sports betting, keno, and bingo from the state-run Hrvatska Lutrija and Prva Sportska kladionica.

In 2014, new legislation meant private operators could apply for an online gambling license from the Ministry of Finance.

This does not affect the ability for offshore online casinos to accept players from Croatia, allowed by a loophole in European regulatory conditions. Though Croatia has done little to prevent this activity, with sites currently unblocked, Hrvatska lutrija did partner with Games Global and Intralot Interactive to increase their range of gaming opportunities.
